Terms of service

The agreement governing LeadMapper subscriptions, credits and account responsibilities.

01Agreement and eligibility

These terms govern your use of the LeadMapper website and software service. LeadMapper, we, us and our refer to the operator of the service. By creating an account, purchasing a subscription or credit pack, or using the service, you agree to these terms and the acceptable use policy. Our privacy policy explains how we handle personal information.

You must be at least 18 and have authority to enter this agreement. If acting for an organisation, you confirm you are authorised to bind it, and you refers to that organisation as well as the account user. Separately agreed written enterprise terms prevail to the extent of a conflict.

02Accounts and free trials

Provide accurate account information, keep it up to date and protect your credentials. You are responsible for authorised activity on your account and must promptly report suspected unauthorised access. Do not share a personal login or transfer an account without our agreement.

Trial access is subject to availability, eligibility and anti-abuse checks. Some requests require review before an invite is issued. A standard trial provides 10 credits, expires 14 days after account creation and returns up to 20 businesses per search. No payment card is required, and a free trial does not automatically become a paid subscription. Trial features and limits are shown on the pricing page.

Do not create multiple accounts to bypass trial, usage or security limits. Paid account creation may require email verification and successful payment before paid features become available.

03Subscriptions, prices and payment

The plan, billing interval, currency, price and credit allowance shown at checkout form part of your purchase. Monthly subscriptions are billed monthly; annual subscriptions are billed annually in advance. Both add included credits each month. Annual billing does not grant a full year of credits at once. Credit packs are one-off purchases.

Subscriptions renew automatically for the same interval unless cancelled before renewal. You authorise our payment provider to charge agreed fees to your selected payment method. Keep payment details current. Failed payments may result in restricted paid features until resolved, with notice where practicable.

Australian pricing is shown in AUD and includes GST as stated on the pricing page. Pricing outside Australia is shown in USD. The final currency, applicable taxes and total are shown before payment. Bank or conversion charges imposed by your provider are your responsibility.

Upgrades may apply immediately with a prorated charge and credit adjustment shown before confirmation. Downgrades and cancellation generally take effect at the end of the paid billing period. Manage your subscription in account billing settings, or contact us if you cannot access them.

We will give reasonable advance notice of changes to recurring prices or material plan limits. Changes apply from a subsequent renewal rather than retrospectively to a paid period. You can cancel before they take effect.

04Credit use and expiry

One credit pays for one successfully retrieved page of up to 20 businesses. A page may return fewer results. Estimates are planning figures; actual charges depend on successful pages retrieved, search points and selected limits. Duplicate removal or filtering can reduce the final unique business count without reducing pages retrieved. Failed pages are not charged, and incorrectly deducted credits can be corrected.

Unused subscription credits carry over for 1 additional month after the month they are granted, then expire under the credit ledger. Credit pack credits expire 12 months after purchase. Trial credits expire under the trial rules above. Your account shows your balance and credit history.

Credits are a limited right to use service features. They are not money, a deposit or a transferable financial asset. They cannot be transferred between accounts, resold or exchanged for cash unless we expressly agree.

05Unused credits and refunds

We do not offer refunds for unused credits. This includes partially unused packs, unused subscription allowances, credits remaining after cancellation and credits that expire. We do not provide a refund solely because you change your mind, use fewer credits than expected or no longer need the service.

Cancellation stops future renewals and does not itself create a refund entitlement for the current paid period or its unused credits. Access continues for the period already paid for, subject to these terms, and remaining credits retain their normal expiry dates.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, refund entitlement or other right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law. If the service fails to meet an applicable consumer guarantee, you may be entitled to a remedy such as correction, cancellation, a refund or compensation, depending on the circumstances. Correcting a search credit charge is separate from a monetary refund and does not affect your rights under applicable law.

06Permitted use and responsibilities

We grant you a limited, non-exclusive right to access LeadMapper during your account term for lawful business research and prospecting within your entitlements. Follow the acceptable use policy, applicable laws and the rights of data owners and third parties.

You are responsible for deciding whether you can lawfully collect, export, store or contact a prospect. A public phone number or website does not itself establish consent to marketing. Follow applicable privacy, spam, telemarketing, do-not-call and unsubscribe requirements. LeadMapper does not supply legal advice or guarantee that an outreach campaign is lawful.

07Listing data and third parties

Results come from public business listings through third-party providers. Availability, coverage and accuracy depend on the source, search area and time of retrieval. Listings can be incomplete, duplicated, changed or out of date. We do not guarantee a particular result count, verified decision-makers, marketing consent, sales or revenue.

Check information before relying on it or contacting a business. Rights in source data remain with their owners. Comply with applicable source and destination platform requirements. LeadMapper is independent and is not affiliated with, endorsed by or sponsored by Google.

Third-party websites and services linked from LeadMapper have their own terms and privacy practices. We do not control their operation.

08Content and intellectual property

You retain your rights in information you upload or create, such as private notes, tasks and pipeline records, subject to third-party rights in underlying listing data. You warrant that you have necessary permissions to provide and use it.

You permit us to host, process, transmit and display your content as needed to provide and secure the service, respond to your instructions and meet legal obligations. This does not give us ownership of your private content.

LeadMapper and its licensors retain rights in the software, branding, designs and documentation. Do not copy, resell or create a competing hosted version, remove ownership notices or seek its source code except where applicable law expressly permits it.

09Availability and changes

We use reasonable care and skill in providing the service. Maintenance, provider interruptions, network failures and security incidents may affect availability. No specific uptime service level is promised unless agreed separately in writing.

We may improve features and change providers. We will give reasonable notice of changes that materially reduce paid functionality where practicable. If discontinuing a paid service or changing it gives you a remedy under applicable law, that remedy remains available. Keep copies of important records using the available exports.

10Liability and mandatory rights

LeadMapper is a research and workflow tool. You are responsible for business decisions, data verification and outreach. To the extent permitted by law, we do not warrant uninterrupted service or complete or error-free third-party listing data.

Subject to rights that cannot lawfully be limited, neither party is liable to the other for indirect or consequential loss arising from this agreement, and each party’s aggregate liability is limited to fees you paid or owe for the service in the 12 months before the event giving rise to the claim.

These limitations do not apply to fraud, wilful misconduct, unpaid fees, either party’s infringement of the other’s intellectual property, or liability the law does not allow to be excluded or limited. Mandatory consumer rights take priority over inconsistent provisions.

11Suspension and account closure

Cancel subscriptions through account billing settings. Contact us to close an account or request deletion of personal information. Subscription cancellation and account deletion are separate actions.

We may restrict or suspend access where reasonably needed to address non-payment, a material breach, fraud, unlawful activity or a security risk. We will explain the reason and allow a reasonable opportunity to resolve it where practicable; urgent risks may require immediate action. We may terminate an account for an unremedied material breach or where continued service would be unlawful.

If we end the service for convenience during a period you have paid for, we will provide a proportionate refund for paid service we no longer provide. The unused-credit rule does not override this obligation or any remedy required by law.

Account closure ends access. Export records you need beforehand. Retention and deletion follow the privacy policy; records needed for legal, billing or security purposes may be retained.

12Changes to these terms

We may update these terms for service or legal changes. The date at the top identifies the current version. Material changes affecting an existing paid account will be notified in advance where practicable and will not remove accrued rights.

If you do not accept a material change, you can stop using the service and cancel before it takes effect. Remedies required by applicable law remain available.

13Disputes, governing law and contact

Contact us through the website contact page about billing questions, complaints or disputes. Both parties will try to resolve disputes in good faith before starting proceedings, except where urgent relief is needed.

These terms are governed by the laws of Australia. Australian courts have non-exclusive jurisdiction, subject to mandatory rights to bring a claim under the laws or in the courts of your location.

If a provision is unenforceable, the remaining provisions continue to apply. Delayed enforcement does not waive a right. These terms, the acceptable use policy and your purchase details form the agreement unless separate written terms have been agreed.
